2012 America’s Declaration of Dependence, and the Death of the Bill of Rights

Because we, as Americans, have not heeded the advice of our Founding Fathers, these times have become the most perilous in our nation’s history.  We engage ourselves in multiple unconstitutional wars oversees, which cause inexcusable death and misery while costing America trillions of dollars at a time when the nation groans under an already unsustainable burden of debt.  Conspired and fiat authority, counting on the apathy of the people, has replaced Constitutional authority.

The list of abuses is vast, while the effects of these encroachments are highly visible in our daily lives.  Officials’ disregard for their oath of office has stifled the prosperity and productivity of America’s industry base with burdensome and unconstitutional regulations and taxes.  In addition, A Declaration of Independence, signed by our Forefathers in 1776, has become a declaration of dependence in 2012 as America seeks treaties and entangling alliances through the United Nations, the North Atlantic Treaty Organization and a dependency of foreign oil.  At the same time policies and a avalanche of “redistribution of wealth” programs have generated a dependency on government from the American people that would shock our Founders.

America has become the monster we fought against 235 years ago.  The standard to which the wise and honest can repair still beckons the wise and honest to repair it, as our liberties hang by a thread.  (read George Washington’s quote HERE)

Grievances; and the Death of the Bill of Rights

In 1913 through the passage of the 17th Amendment, the delicate balance of direct and indirect representation was radically altered, destroying an important check and balance that was the original intent of our forefathers.

In this same year, the 16th Amendment altered the Constitution by destroying our forefathers’ insurance that all taxes be “uniform according to population” (Article 1, Section 9, Clause 4), inviting socialistic “legalized plunder” (as Frederick Bastiat would say) into the Constitution itself.

Also in 1913, the Federal Reserve was created, violating the Constitution by letting a private group of bankers coin and print money, instead of the government (Article 1, Section 10, Clause 1).  This led to the Gold Reserve Act of 1934 which destroyed the required national gold standard (Article 1, Section 10, Clause 1).  The result of the Federal Reserve has been the collection of land and capital to those involved and benefitting from the conspiracy, while bailing out failing, and undeserving, corporations and foreign countries—leaving “We the People,” and primarily America’s children and grandchildren, to pick up the bill.  This is taxation without representation.

Continuing to usher in additional socialism, in defiance of the 9th &10th Amendment, the government issued the Social Security Act of 1935.

The Patient Protection and Affordable Care Act of 2009 invited socialism into our healthcare industries, in violation of the 9th & 10th Amendment.

The federal government has destroyed the 1st Amendment by advocating atheism, an admitted declared religion according to the U.S. Supreme Court (see Lemon v. Kurtzman, 1971 and Wallace v. Jaffree, 1985).  Furthermore, on March 8, 2012 Bill H.R. 347 was signed into law curtailing the 1st Amendment; the Federal Restricted Buildings and Grounds Improvement Act erased “freedom of speech” and “the right of the people to peaceably assemble, and to petition the Government for a redress of grievances” (1st Amendment).

In an act of irresponsibility, the congress and the states have neglected its duty to organize, arm and train constitutional militias according to the manner prescribed in Article 1, Section 8, Clause 15 & 16 of the Constitution.  The militia is a fundamental part of the Union and expressly protected and sanctioned in the above clauses as well as in the 2nd Amendment, in which “the right of the people to keep and bear Arms, shall not be infringed.”

In gradual succession, the Patriot Act of 2001, Military Commissions Act of 2006, and National Defense Authorization Act of 2012 has destroyed America’s fundamental right of Habeas Corpus or “due process”, before protected in Article 1, Section 9, Clause 2 of the Constitution, as well as the 4th, 5th, 6th and 7th Amendments.

On March 16th, 2012, the president issued an executive order entitled “National Defense Resources Preparedness.”  This order takes private business and property out of the hands of the People and puts it under exclusive control of the federal government.  The order calls for forcible “acquisition of materials” by the government (Part I, Section 103, E) and grants authority to heads of departments “to control the general distribution of any material (including applicable services) in the civilian market” (Part II, Section 201, E).  This means that the government can now seize all private industry and goods as well as individuals to be utilized for their “services.”  This is in violation of the 3rd, 4th, 5th & 8th Amendments.

Furthermore, the executive order delegates presidential authority to heads of various governmental agencies, allowing them to compel citizens to assist them for national defense (Part II, Section 201, A), and gives the president authority to use the U.S. military to compel citizens to undergo “labor requirements” in the name of “national defense” (Part VI, Section 601, 4) and “without compensation” (Part V, Section 502).

This order effectively enslaves the American people, ends private property and enterprise, takes all food, goods and surpluses out of the hands of the People, and ends Liberty through the creation of forced slave labor.  These powers shatter the presidential oath of office while mimicking the dictatorial powers of oppression and terror which existed in Nazi Germany and the Soviet Union.  All Executive orders are unconstitutional, but this one qualifies as treason under Article 3, Section 3 of the Constitution.

The Solution

The long train of abuses perpetrated by our public servants is evidence of Americas decent into tyranny.  It is the belief of the Independent American Party that those involved in the conspiracy, who have deceitfully caused this descent, want anarchy.  We call for neither tyranny nor anarchy.  “We the People” must petition government for a redress of our grievances and to speak out forcefully against encroachments.  Article 2, Section 4 and Article 1, Section 3, Clause 7 of the Constitution provide lawful means wherewith corrupt officials, traitors and oath breakers may be removed from office and punished for their oppressive acts, treason, high crimes and misdemeanors.

We unequivocally assert that “We the People” are the guardians of our Liberties and of our God-given rights.  We affirm that our representatives as a whole are in knowing violation of their oath to support and defend the United States Constitution.  We declare that unless an immediate stop is put to the tyrannical usurpations of our officials, the government will devolve into despotism and the Union will be broken up into warring factions.

“We the People” must not surrender our rights, but defend them, even if through the use of our arms.

We reassert that the Constitution is the Supreme Law of the land and cannot be disobeyed without loss of Freedom, Liberty and Independence.  We proclaim that the purpose of government is to secure and defend natural rights from all enemies, foreign and domestic, and that honorable individuals must stand tall in liberty’s defense.  We, in the Independent American Party, will forever defend the liberty of our Fathers with our lives, our fortunes, and our sacred honor, so help us God.
