What is A Red Flag Law?

“Red Flag Laws” are also known as Extreme Risk Protection Orders (ERPOs) or Gun Violence Restraining Orders (GVROs). Essentially it enables law enforcement, and sometimes family members or even concerned parties, to petition a judge to remove guns from individuals who pose a threat to themselves or others. A judge makes the determination to issue the order based on statements and actions made by the gun owner in question. Refusal to comply with the order is punishable as a criminal offense. After a set time, the guns are returned to the person from whom they were seized unless another court hearing extends the period of confiscation

 

National polling has shown widespread support for laws that create a process to temporarily remove firearms from people deemed to be dangerous to themselves or others. There are states who say they have seen reductions in the number of suicides by firearm with ‘Red Flag’ bills.  At least 13 states have now passed extreme risk laws, with a variety of methodology for implementing confiscation orders.

 

How the law affects the U. S. Constitution

Officers can search you home for weapons, a violation of the 4th amendment prohibiting unreasonable search and seizures

We are talking violations of not just the Second, but the Fourth and the Fifth amendments of the Constitution of the United States of America. Multiple violations of the literal “Law of the Land!”

🛑 Ban on high-capacity ammunition magazines
🛑 Prohibiting those guilty of political incorrectness to own firearms

Registration of all guns and ammo

 a twenty-eight-day waiting period for purchases;

 mandatory safety training courses;

more detailed background checks;

bans on large-capacity magazines;

bans or greater restrictions on military-style firearms and ammunition.
